RECENT  MATTERS

  • On behalf of a small business that sued its building contractor and lending institution, obtained reversal and rendition of a six-figure Rule 13 sanction.  Fast Invs., LLC v. Prosper Bank, No. 02-13-00026-CV, 2014 Tex. App. Lexis 2600 (Tex. App.--Fort Worth Mar. 6, 2014, no pet.) (mem.op.);

  • Awarded a six-figure Rule 13 sanction for client   sued for defamation;

  • Won trial court dismissal of defamation suit against reporter and award of attorneys' fees under Texas Citizen's Participation Act (TCPA);

  • Won dismissal of appeal of order granting motion to dismiss under TCPA on basis that appellate court lacked subject matter jurisdiction. Flynn v. Gorman, No. 02-16-00131-CV, 2016 Tex. App. Lexis 10032 (Tex. App.--Fort Worth Sept. 8, 2016, no pet.) (mem. op.);

  • Negotiated favorable resolutions for clients undergoing business divorce.  

  • On behalf of physician whose employee embezzled over $1.3 million, negotiated favorable settlement with bank that opened employee account and with staffing agency that placed employee to work in physician's office;

  • Won dismissal of paternity action brought by alleged adult child on basis that suit was barred by residual limitations period.  Court also awarded over $35,000 in attorneys fees;

  • Negotiated favorable settlement of suit under Fair Labor Standards Act on behalf of employer;

  • Obtained favorable settlement of copyright suit against newspaper; 

  • Negotiated quick, favorable settlements on behalf of defendants in numerous suits seeking to enforce non-compete agreements;

  • Obtained pre-suit settlement on behalf of client claiming attorney malpractice.
